Terms and Conditions 

  1. Eligibility 

To use our services, you must be of legal age and capable of entering into a legally binding agreement. By accessing or using our platform, you represent and warrant that you meet these requirements. If you are using the platform on behalf of a company or other legal entity, you warrant that you are authorized to do so. 

  1. Term 

These Terms and Conditions remain in effect as long as you continue to access or use our platform. We reserve the right to terminate or suspend your access to our platform at any time, with or without notice, for any breach of these terms. 

  1. Vendors and Reviews 

Vendors listing properties on our platform must provide accurate and truthful information. Users are encouraged to leave honest reviews based on their experiences. We reserve the right to moderate, edit, or remove reviews that violate our guidelines or contain inappropriate content. 

  1. User Disputes 

Any disputes between users, including those between customers and property owners, must be resolved directly between the parties. We are not liable for any claims, damages, or disputes arising from user interactions on our platform. 

  1. Payment Methods 

We support various payment methods for bookings, including credit/debit cards, online banking, and third-party payment gateways. All payments must be made in the currency specified at the time of booking. Users are responsible for ensuring their payment information is accurate and up to date. 

  1. Prohibited Content 

Users are prohibited from posting or sharing content that: 

  • Is illegal, defamatory, abusive, obscene, or otherwise objectionable. 

  • Violates the intellectual property rights of others. 

  • Promotes discrimination, violence, or hate speech. 

  • Contains viruses or harmful code. 

We reserve the right to remove any content that violates these terms. 

  1. Event Cancellation 

If an event or booking is cancelled by the property owner or customer, the refund policy outlined at the time of booking will apply. We are not responsible for any losses incurred due to cancellations. 

  1. Disclaimer 

Our platform is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or suitability of any property listed on our platform. 

  1. Permission of Activities 

The permissions for activities such as sound, liquor, or any other regulated activities must be obtained directly from the property owner. StayBuzz Services Pvt. Ltd. does not facilitate or guarantee such permissions. The property owner is solely responsible for adhering to local laws and obtaining necessary permits. StayBuzz Services Pvt. Ltd. shall not be liable for any damages, penalties, or legal complications arising from such permissions granted by the property owner. 

  1. Accidental Incidents 

We will not be liable for any accidental incidents, including but not limited to fire accidents, electrical shocks, injuries, or fatalities that may occur during the use of the property. Guests are solely responsible for ensuring their own safety and the safety of their companions. We strongly advise all guests to take appropriate precautions and follow all safety guidelines provided at the property. 

  1. Prohibition of Illegal Substances 

The use, possession, or distribution of illegal substances is strictly prohibited on all properties listed on Staybuzz. We do not condone or support such activities and are not responsible for any violations of this policy by guests or third parties. Property owners are also advised to ensure compliance with local laws and regulations. Any breach of this clause may result in immediate cancellation of the booking, eviction from the property, and potential legal action. 

  1. Property Rules and Compliances 

All property rules are set by the property owner, and it is the customer’s responsibility to adhere to them during their stay. Property owners are required to clearly list all applicable rules, amenities, services, and property details accurately on the Staybuzz App/Website. Any changes to services, amenities, or property details must be promptly updated by the property owner on the App/Website to ensure accurate representation. 

  1. Fulfilment of Amenities and Services: 

Property owners are obligated to provide all amenities and services as listed on the Staybuzz App/Website. If they are unable to fulfil any listed amenity or service, they must promptly inform the customer and update the same on the App/Website. In such cases, we encourage property owners to offer partial refunds to customers as a goodwill gesture. 

  1. Additional Charges and Incidents 

For matters such as late checkouts, property damage, cleaning charges, or extra charges for services utilized at the property, property owners are solely responsible for collecting these charges directly from the customer. Staybuzz will not mediate or assume responsibility for such matters unless explicitly stated on our App/Website. Customers and property owners are encouraged to communicate directly to resolve such issues. 

  1. Indemnity 

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of our platform, your violation of these terms, or your violation of any third-party rights. 

  1. Limitation of Liability 

To the fullest extent permitted by law, our liability for any claims arising out of your use of our platform is limited to the amount you paid for the relevant booking or service. 

  1. Disputes 

Any disputes arising from these terms or your use of our platform shall be governed by the Arbitration and Conciliation Act. You agree to submit to the exclusive jurisdiction of the courts in Ranga Reddy District, Hyderabad, Telangana State. 

  1. Waiver 

Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other rights under these terms. 

  1. Severability 

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

  1. Statute of Limitations 

Any claim or cause of action arising from your use of our platform must be filed within one (1) year from the date the claim arose or be forever barred. 

  1. Grievance Redressal  

If you have any grievances or concerns, please contact us at __________________. We will address your concerns in accordance with applicable laws and strive to resolve your issue promptly. 

  1. Responsibility of Property Owners 

We act solely as a platform to connect customers and property owners, both online (via our app, website, and social media channels) and offline (via direct customer requests). We are not directly or indirectly responsible for any business permissions, tax obligations, damages caused by customers, or any legal complications arising from property listings. Property owners are fully responsible for: 

  • Securing all necessary permissions and licenses to operate their business. 

  • Paying applicable taxes as per their tax slabs. 

  • Addressing and resolving any issues that arise at their property, including those involving customers. 

  1. Force Majeure 

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, government actions, or network failures. 

  1. Modifications 

We reserve the right to update or modify these terms at any time. Continued use of our platform after such modifications constitutes your acceptance of the updated terms. 

By using our platform, you agree to these Terms and Conditions. If you do not agree, please refrain from using our services.
